Krofter is an online live shopping platform that allows professional and private sellers to broadcast live content and sell their products to buyers located in the European Union, through auctions, flash sales, raffles and permanent catalogue. Access to the platform is free; the use of certain services may involve payments detailed in the general Terms.
3. Terms of use
Accessing and using the site implies express acceptance of the published Terms and Conditions, as well as of the Privacy Policy and the Cookie Policy. The user undertakes to make appropriate use of the site, in accordance with the law and these Terms, refraining from using it for unlawful purposes, purposes harmful to the rights of third parties, or in ways that impair the operation of the platform.
4. Intellectual and industrial property
All the website's content (texts, images, trademarks, logos, software, source code, design, structure, database, etc.) is owned by Krofter or by third parties who have authorised its use, and is protected by Spanish and European intellectual and industrial property regulations. Any reproduction, distribution, public communication or transformation without the express authorisation of the owner is prohibited.
The content uploaded by sellers (product images and descriptions, live video, etc.) is the responsibility of the sellers themselves, who grant Krofter a non-exclusive, worldwide and royalty-free licence to host, display and promote it within the platform.
5. Liability
Krofter does not guarantee the uninterrupted availability of the website or the complete absence of technical errors. Nor is it liable for any damage or loss arising from interference, omissions, interruptions, viruses or disconnections originating from causes beyond its control.
Krofter acts as an information society service provider that facilitates the intermediation between sellers and buyers. The information on the products published (price, description, photographs, availability) is provided by the sellers and is their responsibility. Krofter is not a party to the sale contract concluded between seller and buyer, without prejudice to the guarantees offered by the Buyer Protection and the mediation functions set out in the general Terms.
6. Third-party links
Krofter may include links to third-party websites (carriers, payment gateways, social networks…). Krofter is not responsible for the content or the privacy policies of those sites.
7. Applicable law and jurisdiction
These conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the consumer's place of residence if acting as such. In all other cases, to the Courts and Tribunals of Huelva (Spain).
